Terms & Conditions of Sale

Please read these Terms & Conditions before placing an order. By placing an order through our website and completing payment through Stripe, you agree to these terms. These terms apply to consumer purchases of Memorial Candles products in the United Kingdom.

We sell memorial lanterns, including models MC001–MC007, together with the LED candle insert stated in the relevant product description. Product descriptions, dimensions, materials and included items are shown on the website.

Because glass, mirrored and iridescent surfaces respond to light and screen settings differently, product photographs may show small visual differences in reflections or tone. We do not use this clause to excuse a product that is materially different from its description.

3. LED candle inserts

The included LED insert is intended to create a flame-effect light. Battery requirements are described on the product page. Batteries are not included unless expressly stated. Customers should follow any safety instructions supplied with the LED insert and use only suitable batteries or candle inserts.

4. Prices

Prices are shown in pounds sterling (GBP) and include any applicable taxes that we are required to charge. The price shown at checkout is the price payable for the order. We may change prices for future orders at any time, but changes do not affect an order already accepted.

5. Free UK delivery

Standard delivery to UK addresses is free for the current MC001–MC007 collection. Delivery arrangements are described in our Delivery Policy. If a delivery location cannot be served by our carrier, we will contact you and offer appropriate options, including cancellation and refund where necessary.

6. Placing an order and contract formation

When you submit an order and payment through Stripe, you make an offer to buy the selected product. A contract is formed when we confirm acceptance of your order by email or when we dispatch the goods, whichever occurs first. If we cannot accept the order, we will notify you and refund any payment taken.

7. Payment through Stripe

Online payments are processed using Stripe. Depending on the payment methods enabled and your device, Stripe Checkout may offer payment cards and compatible digital wallets. Stripe may carry out authentication, fraud prevention and other checks required to process a payment.

We do not ask customers to send card numbers by email. Payment information entered into Stripe Checkout is handled by Stripe in accordance with Stripe’s own terms and privacy information.

8. Order confirmation

After a successful order, an order or payment confirmation will be sent electronically to the email address provided. Please keep this confirmation for your records and check the order details promptly.

9. Delivery

We will deliver in accordance with the Delivery Policy and any delivery information shown before purchase. Unless a different period is agreed, goods will be delivered within 30 days of the contract being made.

10. Cancellation, returns and refunds

Online consumer orders are subject to the cancellation and return rights described in our Returns & Refunds Policy. In general, consumers may cancel a distance order within 14 days after receiving the goods and then have a further 14 days to return them, subject to legal exceptions and rules about diminished value.

11. Faulty or misdescribed goods

Nothing in these terms limits your statutory rights. If goods are faulty, damaged, not as described or not fit for purpose, the remedies available under UK consumer law may include rejection, refund, repair, replacement or price reduction depending on the circumstances. 12. Your responsibilities

• Provide accurate contact and delivery information.
• Use the lantern and LED insert in accordance with supplied instructions and the intended memorial use.
• Do not use a damaged electrical or battery-powered insert.
• Keep packaging and proof of purchase where reasonably practical if you need to contact us about a return or fault.

13. Our liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or liability arising from statutory consumer rights that cannot lawfully be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was made, except where the law provides otherwise. These terms do not affect rights that cannot be excluded by contract.

14. Events outside our reasonable control

We are not responsible for a delay caused by an event outside our reasonable control, but we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect. Your statutory rights concerning delayed delivery remain unaffected.

15. Personal data

We use personal data in accordance with our Privacy Policy. Payments are processed through Stripe, which also processes personal data for payment, authentication, security and fraud prevention purposes.

16. Changes to these terms

We may update these terms from time to time. The terms that apply to your purchase are the version made available to you when you place the order, unless a change is required by law and applies to an existing contract.

17. Governing law and courts

These terms are governed by the law of Scotland. If you are a consumer living elsewhere in the United Kingdom, you also retain any mandatory protections and rights to bring proceedings in courts available to you under applicable consumer law.
